In no event shall Zoho be liable to you or any third party for any special, incidental, indirect, punitive, exemplary or consequential damages, or damages for loss of business, profits, business interruption or loss of business information resulting from the use of or inability to use the Program, or for any claim of any other party, even if Zoho has been advised of the possibility of such damages. Zoho`s total liability with respect to its obligations under this Agreement or otherwise with respect to the Licensed Software shall not exceed the amount of the license fee you paid for the Licensed Software. You must be of legal age to enter into a binding agreement in order to accept the terms. If you do not agree to the Terms and Conditions, do not use any of our services. If you accept the Terms and Conditions and do not accept any Terms specific to the Service, do not use the applicable Service. You may accept the Terms by checking a box or clicking a button indicating your acceptance of the Terms, or by actually using the Services. The following terms constitute a binding agreement between you and Zoho Corporation Pvt. Ltd. (“Zoho”) with respect to your use of Zoho Analytics On-Premise (“Licensed Software”). If you only want to license certain employees in your organization, select the flexible pricing plan for users.
This was done in response to market and customer needs. Some companies turned to us to tell us that they really wanted to use Zoho One, but in some cases, they only needed access for some of their employees, and in other cases, the engagement required the consent of multiple decision makers, so the decision was delayed. Now, companies like this can only buy Zoho One for employees who need it. This flexibility has a different price. This Agreement constitutes the entire agreement between you and Zoho with respect to its subject matter and supersedes and combines all prior proposals, agreements and communications. Any waiver or modification of this Agreement will only be effective if made in writing and signed by both parties. You may not assign, transfer or delegate any right or obligation under this Agreement, and any unauthorized assignment will be void. Zoho may assign this Agreement and its rights and obligations to any of its affiliates or in connection with any merger, reorganization, acquisition or other transfer of all or nearly all of its assets or voting securities to which this Agreement relates. This Agreement does not create or imply any partnership, agency or joint venture. The Licensed Software is intended for use in conjunction with Zoho Docs (“hosted Service”).
ZOHO hereby grants YOU a non-exclusive, non-transferable, worldwide license to use the Licensed Software, including user documentation and updates to which YOU are entitled as part of your subscription to the Hosted Service. YOU understand that YOU will require a valid subscription to the Hosted Service to use the Licensed Software and that YOU will not be able to use the Licensed Software if the subscription to the Hosted Service expires or is otherwise terminated. .
